Hereinafter referred to as “Airpact,” “the Seller,” or “we.”
Article 2 — Purpose and Scope
These Terms and Conditions of Sale (the “Terms”) govern all distance sales of products concluded between Airpact and any individual or legal entity (the “Customer”) making a purchase on the Site, regardless of country of residence.
Any order placed on the Site implies full and unconditional acceptance of these Terms, to the exclusion of any other document. Airpact reserves the right to modify these Terms at any time; the Terms applicable to an order are those in effect on the date the order is placed.
Article 3 — Products
Airpact sells portable fans and related accessories. The essential characteristics of each product (description, images, price) are presented on the corresponding product page of the Site.
Photographs and visuals illustrating the products have no contractual value; minor variations between the product shown and the product delivered (color, finish) shall not engage Airpact's liability nor constitute grounds for non-conformity.
Airpact reserves the right to modify the range of products offered for sale at any time.
Article 4 — Price
Prices are shown on the Site in the currency displayed at the time of the order (notably in euros for Customers billed in EUR), inclusive of all taxes, exclusive of delivery fees, which are specified and added before final confirmation of the order.
For orders shipped outside the country of dispatch, customs duties, import taxes, or similar charges may be due from the Customer upon receipt, in accordance with the regulations of the destination country. These charges are the Customer's sole responsibility and are not Airpact's liability.
Airpact reserves the right to change its prices at any time, it being understood that the price applicable to an order is the one in effect at the time the order is confirmed.
Article 5 — Order
The Customer selects the products of their choice, adds them to their cart, and confirms their order after reviewing the details and the total price (products + delivery fees).
The order is final only once payment has been confirmed. An order summary is sent by email to the Customer at the address provided when placing the order.
Airpact reserves the right to cancel or refuse any order in the event of proven or suspected fraud, non-payment, or stock unavailability of the ordered product. In the event of stock unavailability, the Customer is informed and fully refunded the corresponding amount.
Article 6 — Order Cancellation
Due to the way the Site operates (orders are transmitted quickly, sometimes automatically, to third-party suppliers responsible for preparation and shipping), the Customer may only request cancellation of their order as long as it has not yet been forwarded to the supplier for processing, which in practice means within twelve (12) hours of the order being confirmed.
To request cancellation within this period, the Customer must contact Airpact without delay at the address indicated in Article 1. Airpact will make reasonable efforts to process the request before it is forwarded to the supplier, but cannot guarantee this if the order has already been taken in charge by the supplier.
Beyond this period, or if the order has already been forwarded to the supplier, cancellation can no longer be guaranteed. The Customer retains the right to exercise their right of withdrawal after receiving the product, under the conditions set out in Article 9.
Article 7 — Payment
Payment is due immediately upon ordering, using the payment methods offered on the Site (credit card and any other methods that may be available via the payment platform).
Transactions are secured by the Site's payment provider. Airpact does not store any of the Customer's banking information.
Article 8 — Delivery
Products are delivered to the address provided by the Customer when placing the order, within the geographic areas served by the Site.
The estimated delivery time is seven (7) to fourteen (14) business days from order confirmation, varying by destination. Delivery fees vary by delivery location and are calculated and displayed to the Customer before final confirmation of the order, in accordance with Article 4.
Delivery times are provided for guidance only. A delivery delay only entitles the Customer to cancel the order under the conditions provided by the law applicable to the Customer.
The Customer must inspect the condition of the parcel upon receipt and report any anomaly (damage, missing parcel) within the time limits set by the carrier.
Article 9 — Right of Withdrawal (Customers residing in the European Union / European Economic Area)
In accordance with European consumer protection regulations, Customers residing in the European Union or the European Economic Area have a period of fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without having to provide a reason or pay a penalty, except for return shipping costs.
To exercise this right, the Customer must notify Airpact of their decision by email at the contact address indicated in Article 1, before the 14-day period expires.
The product must be returned in its original condition, complete, within 14 days of notifying the withdrawal. Return shipping costs are borne by the Customer, unless otherwise communicated by Airpact.
The refund is issued within a maximum of 14 days from receipt of the returned product (or proof of shipment), using the same payment method used for the order.
As a matter of business policy, Airpact applies the same return policy to Customers residing outside the European Union / European Economic Area: a period of 14 calendar days from receipt of the product, under the same conditions described above, without this constituting recognition of a legal right of withdrawal equivalent to that applicable to Customers in the EU/EEA.
Article 10 — Warranties
For Customers residing in the European Union, products benefit from the legal warranty of conformity applicable in their country of residence, without prejudice to any additional commercial warranty that Airpact may offer.
For Customers residing outside the European Union, products are warranted against manufacturing defects under the conditions and time limits provided by applicable law, as well as by any commercial warranty that may be communicated on the Site.
Any warranty claim must be sent to Airpact via the contact address indicated in Article 1, accompanied by proof of purchase.
Article 11 — Liability
Airpact shall not be held liable for failure to perform the contract in the event of force majeure, stock unavailability beyond its control, or fault attributable to the Customer or to a third party unrelated to the supply of the products.
The products sold are everyday electronic devices; they must be used in accordance with their instructions. Airpact shall not be held liable for improper use of the product by the Customer.
Article 12 — Personal Data
Personal data collected as part of an order is processed by Airpact for the purpose of managing the business relationship, under the conditions described in the Site's Privacy Policy.
For Customers residing in the European Union, this processing is carried out in accordance with the General Data Protection Regulation (GDPR). Customers have rights of access, rectification, erasure, and objection as provided by applicable regulations, exercisable via the contact address indicated in Article 1.
Article 13 — Intellectual Property
All elements of the Site (text, visuals, the Airpact logo, trademarks, content) are the exclusive property of Airpact or its partners and are protected by applicable intellectual property laws. Any reproduction or unauthorized use is prohibited.
Article 14 — Complaints and Mediation
For any question or complaint, the Customer may contact Airpact at the address indicated in Article 1.
For Customers residing in the European Union, in the event of a dispute not resolved directly with Airpact, the Customer may use the European Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.
Article 15 — Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without prejudice to the mandatory consumer protection provisions, if any, that benefit the Customer under the law of their country of residence, which remain applicable notwithstanding any contrary choice of law stipulated herein.
Failing an amicable resolution, any dispute shall be subject to the competent jurisdiction determined in accordance with applicable rules of private international law, subject to the mandatory rights of consumer Customers residing in the European Union to bring proceedings before the courts of their own country of residence.
Article 16 — Miscellaneous Provisions
If any clause of these Terms is held to be null or unenforceable, the other clauses shall remain in full force and effect.
The fact that Airpact does not, at a given time, rely on any clause of these Terms shall not be interpreted as a waiver of the right to rely on that same clause at a later time.
